Probating an estate takes place in the Probate and Family Court and follows certain procedures depending upon whether someone dies leaving a will or not. The process begins when someone petitions the court to be appointed executor or administrator and, upon appointment, this person is charged with gathering and accounting for the deceased's assets, paying their lawful debts and expenses of administration, and ultimately making sure that estate assets are distributed according to the decedent's wishes.
With mandated timelines the probating of an estate can take a year or more. During that time issues often arise relative to the payment of the decedent's debts, the sale of real estate, stock, or other assets, and the timing of distributions to heirs. On occasion, disputes arise with creditors or friends and family members who make a claim on estate assets. These disputes are sometimes resolved through negotiation or mediation, but if necessary the court will conduct an evidentiary hearing and issue a judgment.
